Elvin Esteves, Of Counsel

Elvin Esteves is a multi-purpose business litigator who concentrates his practice on complex business and commercial litigation involving contract disputes, business torts and intellectual property litigation. Mr. Esteves manages, supervises and handles all aspects of litigation in federal and state courts and alternative dispute resolution, including e-discovery, taking and defending depositions, arguing motions, making other court appearances and participating in settlement conferences. His intellectual property experience includes patent, trade secret, trade dress, copyright and licensing disputes. He has extensive experience working with national counsel on intellectual property litigation in the DNJ and the SDNY, including litigation arising out of method patents, design patents and Abbreviated New Drug Applications (ANDAs) under the Hatch Waxman Act. Mr. Esteves has worked with damages experts in patent litigation involving claims for reasonable royalties and lost profits. Representative clients in patent litigation have included Raritan Computers, LG Electronics, Earthlink, Lending Tree, Ferring Pharmaceuticals, Bausch & Lomb and Valeant Pharmaceuticals. The underlying technologies have varied from camera tripods, software, pharmaceutical products, computing equipment and modular industrial air-conditioning technology.

Mr. Esteves has extensive experience with internal investigations and the defense of white collar crime and regulatory enforcement actions, including alleged medicare billing irregularities for physical therapy services, alleged accounting irregularities regarding the booking and reporting of quarterly earnings to meet earnings expectations, and the alleged failure to file timely FDA required field alerts by a pharmaceutical company regarding out-of-specification manufacturing results.

Mr. Esteves also has extensive alternative dispute experience involving mediation and arbitration. He secured an American Arbitration Association award on behalf of a medical device company in the amount of $3.3 million against a former distributor in a dispute involving the breach of restrictive covenants and unfair competition. The award was confirmed in Federal Court in the DNJ. Mr. Esteves was formerly a member of the American Arbitration Association (“AAA”) panel of neutrals for complex commercial arbitration.

Mr. Esteves has over two decades of experience working for premier firms in New Jersey and New York. His previous employment experience includes Willkie Farr & Gallagher where he was an Associate and more recently Gibbons, PC., where Mr. Esteves was an Associate, Counsel and Partner in the Business & Commercial Litigation and Intellectual Property groups.
